Alina Habba has resigned as New Jersey's top federal prosecutor. This follows a court battle that invalidated her legal standing to hold the office.
The head of the Justice Department, Pam Bondi, announced her stepping down on the start of the week. She commented that the judicial decision made it "untenable" for her to lead the department effectively.
"But do not mistake compliance for surrender," she declared. "The effort will now reach across America."
The departure was triggered by a federal appellate panel determined that she had been acting without proper authority as US attorney. This ruling is expected to impact scores of prosecutions in the state.
The appellate judges said that a temporary posting that bypassed Senate approval ran afoul of the statute on vacant positions.
It was also stated that the former prosecutor will continue working within the DOJ as a senior adviser. She will seek further review of the court's action, aiming for a different outcome.
In a statement, the Attorney General contended that the judiciary "cannot be permitted to override the appointment of attorneys tasked with carrying out the fundamental role of the presidency of prosecuting crime."
The attorney general highlighted her tenure and pointed out that while she was in charge, the Newark saw a significant drop in offenses. Additionally that the Camden recorded its initial homicide-free summer since 1974 free from homicides.
Habba, first joined Donald Trump's lawyers in 2021. She went on to represented Trump in his New York criminal case in New York last year, when he was conviction on 34 counts of falsifying business records.
Prior to her appointment to the top New Jersey post, Donald Trump had revealed he was appointing her as his senior adviser during his second administration, calling her as "unwavering in her loyalty" and a dedicated fighter for justice.
